Possibly, yes. Illinois follows a modified comparative negligence system. You may still pursue compensation if you were partially responsible for the motorcycle crash, as long as your share of fault is not more than 50%. Your financial recovery is reduced by the percentage of fault assigned to you. For example, if you were awarded $100,000 but found to be 20% at fault, your recovery would be reduced to $80,000. However, if you are found 51% or more at fault, you may be barred from recovering damages.
