What if the at-fault driver doesn’t have insurance?
New York requires auto policies to include uninsured motorist coverage for bodily injury at the state minimum limits. This coverage may help if the other driver has no insurance or in certain hit-and-run situations. New York also allows drivers to purchase Supplementary Uninsured/Underinsured Motorist (SUM) coverage, which may apply when the at-fault driver has no insurance or not enough coverage for your losses. Your attorney can review your policy and identify which coverage may apply.
